Regulation 953/2021 lays down in recital 36 that "direct or indirect discrimination of persons who are not vaccinated, for example for medical reasons, because they do not fall within the target group for which the covido vaccine currently administered or authorized, such as children, or because they have not yet had the opportunity to be vaccinated or have chosen not to be vaccinated. This Regulation shall not be interpreted as establishing a right or an obligation to vaccinate. European standards prevail over national ones. In fact, Article 9 of Decree Law 52/2021, which introduces the greenpass expressly provides for the applicability of Italian rules only if compatible with Regulation No 953/2021. so the greenpass is optional
